1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website https://siaroofing.com ("Site") and any related services, forms, inspections, quotes, SMS messages, emails, and communications offered by SIA Roofing LLC, a Florida limited liability company ("SIA Roofing," "Company," "we," "us," or "our"). By accessing or using the Site, submitting a form, requesting services, or communicating with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old and either the legal owner of the property for which you are requesting services, or an authorized agent of the owner, to use the Site or request services. The Site and our services are intended for residents of the United States, specifically the Miami-Dade, Broward, and Palm Beach County service areas in Florida.

3. Services

SIA Roofing LLC provides residential and commercial roofing services, impact-window installation, and related inspections and repairs in South Florida. Any price, quote, or estimate provided through the Site, a form, SMS, email, or over the phone is preliminary and non-binding until confirmed in a signed written agreement following an in-person inspection. Final pricing, scope, warranty, and timeline are set only in the written services agreement you sign.

4. Lead Form & Contact Consent

By submitting a form, requesting a quote, or otherwise providing your contact information through the Site, you agree that SIA Roofing LLC and its representatives may contact you by phone, SMS, and email regarding your inquiry, including using automated or prerecorded calls and messages. You understand that consent to be contacted is not a condition of any purchase. Standard message and data rates may apply. You can revoke consent at any time using the opt-out instructions in Section 5 or by contacting us.

5. SMS Program

This SMS program delivers appointment confirmations, service updates, and project notifications to customers who have opted in through siaroofing.com or approved forms.

Opt-In Method: You opt in by checking the consent checkbox on the contact or quote request form at siaroofing.com. The checkbox reads:

"I agree to receive SMS messages from SIA Roofing LLC regarding my appointment and project updates. Msg & data rates may apply. Reply STOP to unsubscribe."

Consent is not a condition of purchase.

Message Content: Appointment reminders, reschedules, service updates, and follow-ups.

Cancellation & Help: Reply STOP to any message to opt out. You will receive one final confirmation, after which no further messages will be sent unless you re-opt in. Reply HELP or email erez@siaroofing.com for assistance.

Frequency: Varies based on your service schedule, typically 2–6 messages per service appointment. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Supported Carriers: Our messaging program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and others.

Data Protection: No mobile information, including SMS opt-in data and consent, is shared with third parties, affiliates, or subcontractors for any purpose.

6. Electronic Communications

By using the Site or providing us with contact information, you consent to receive communications from us electronically (email, SMS, or posted on the Site). You agree that all notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

7. Advertising & Tracking

We run advertising campaigns on Meta (Facebook/Instagram), Google (Search, YouTube, Display), and other platforms. When you visit the Site, cookies, tracking pixels, and server-side tracking tools may collect information about your visit and send it to advertising and analytics partners for the purposes described in our Privacy Policy. By using the Site you acknowledge and consent to these practices as described in the Privacy Policy.

8. Intellectual Property

All content on the Site — including text, logos, graphics, photographs, video, and the SIA Roofing name and marks — is owned by or licensed to SIA Roofing LLC and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, copy, distribute, modify, or create derivative works from any Site content without our prior written permission, except to view and print pages for your own personal, non-commercial use.

9. User-Submitted Content

If you submit content to us — including reviews, testimonials, photos of your property, feedback, or comments — you grant SIA Roofing LLC a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, reproduce, modify, publish, and display that content in connection with our business, including in advertising, case studies, and marketing materials. You represent and warrant that you own or have the rights to submit the content and that it does not violate any third-party rights.

10. User Responsibilities

You agree to:

• Provide accurate, current, and complete information when requesting services or submitting forms
• Use the Site only for lawful purposes
• Not attempt to interfere with, damage, or gain unauthorized access to the Site, its servers, or any connected systems
• Not scrape, data-mine, or reverse-engineer the Site

11. Third-Party Links & Services

The Site may contain links to third-party websites or reference third-party services (such as scheduling tools, payment processors, or insurance portals). We do not control and are not responsible for the content, privacy practices, availability, or reliability of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that third party's terms.

12. Disclaimers

The Site, its content, and any services provided through it are offered "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that:

• The Site will be error-free or uninterrupted
• Any defects will be corrected
• Estimates or quotes displayed on the Site are final or binding
• Any content is accurate, complete, or current

All roofing and window services we perform for you are warranted only as expressly stated in your signed written services agreement, and no other warranties apply.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall SIA Roofing LLC, its owners, officers, employees, subcontractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or damage to property, arising out of or in connection with your use of the Site or your reliance on any content, estimate, or communication provided through the Site, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or your use of the Site (excluding our obligations under a signed written services agreement, which are governed by that agreement) shall not exceed five hundred U.S. dollars ($500.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless SIA Roofing LLC, its owners, officers, employees, subcontractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to us.

15. Termination

We may suspend or terminate your access to the Site at any time, without notice, if you violate these Terms, engage in fraudulent behavior, or for any other reason at our sole discretion. Sections that by their nature should survive termination (including Sections 8, 9, 12, 13, 14, 16, 17, 18, and 20) shall survive.

16. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to the arbitration provision in Section 17, any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

17. Dispute Resolution — Binding Arbitration & Class Action Waiver

Informal Resolution First. Before filing any arbitration or lawsuit, you agree to first contact us at erez@siaroofing.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration. Except for claims that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or any communication from us (a "Dispute") shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Miami-Dade County, Florida, before a single arbitrator. Judgment on the award may be entered in any court with jurisdiction.

Class Action & Jury Trial Waiver. YOU AND SIA ROOFING LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. YOU AND SIA ROOFING LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to erez@siaroofing.com within 30 days of first accepting these Terms. The notice must include your full name, address, and a clear statement that you wish to opt out of arbitration.

Exceptions. Either party may seek injunctive relief in court to protect intellectual property rights.

18. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including hurricanes, tropical storms, floods, fires, acts of God, labor disputes, supply chain disruptions, pandemics, or governmental actions.

19. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted at https://siaroofing.com/terms-of-service with a new "Last Updated" date. Continued use of the Site after changes become effective means you accept the updated Terms. If you do not agree to the updated Terms, stop using the Site.

20. Miscellaneous

• Severability: If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms does not waive that right or provision.
• Entire Agreement: These Terms, together with the Privacy Policy and any signed written services agreement between you and SIA Roofing LLC, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
• Headings: Section headings are for convenience only and do not affect interpretation.
